Importance of the Judgment:
The Madurai Bench of the Madras High Court held that mere issuance or pendency of incidental or minor charges during the period of suspension cannot defeat an employee’s right to full service and monetary benefits, when the criminal case forming the basis of suspension ends in acquittal and no punishment ultimately survives.
The Court further held that an employee acquitted in a criminal case is entitled to have the entire period of suspension treated as duty with full pay and allowances. Revocation of suspension followed by permission to retire amounts to deemed reinstatement, and the principle of “no work, no pay” has no application in such cases.
